A federal judge in Wyoming has dismissed Casper radiologist Eric Cubin, MD’s transgender issue-based lawsuit against the state’s governor, Mark Gordon, Cowboy State Daily reported April 14.
Last year, Cubin spoke out in personal support of Chloe’s Law, a law that went into effect in July 2024 that restricts Wyoming physicians’ ability to provide transgender medical treatments and perform surgeries on minors, and against Wyoming Medical Society (WMS)’s public opposition to it.
Cubin, at the time a member of the Wyoming Board of Medicine, was forced to resign from the board after he raised his issues and then sent an email to state legislators blasting the society’s leadership. He sued Gordon in both his personal and official capacities, claiming unlawful retaliation for exercising free speech. Cubin also sought to have his position restored.
U.S. District Judge Scott Skavdahl ruled against Cubin April 14 and closed the case.
“The issue with Dr. Cubin’s email to the Wyoming House of Representatives is not his expression of support for Senate File 0099; it is the public airing of his dispute with the Wyoming Medical Society’s leadership,” Skavdahl noted.
The court previously denied Cubin’s request for preliminary injunction to restore him to a position on the board while the lawsuit proceeded. Cubin is pursuing interlocutory appeal from that decision.
